Australia admits cyber defences 'inadequate' as medical hack hits millions

Sydney (AFP) – Hackers accessed millions of medical records at one of Australia's largest private health insurers, the company said Wednesday, prompting the government to admit the nation's cyber safeguards were "inadequate". 

This was the latest in a series of hacks targeting millions of people that have brought Australian companies' lax approach to cyber security into sharp relief. 

Medibank chief executive David Koczkar said information about each of the company's 3.9 million policy holders -- some 15 percent of Australia's population -- had been compromised. 

"Our investigation has now established that this criminal has accessed all our private health insurance customers' personal data and significant amounts of their health claims data," he said in a statement to the Australian stock exchange. 

"This is a terrible crime. This is a crime designed to cause maximum harm to the most vulnerable members of our community." 

The cyber attack was revealed last week, but it was not known until now how many people were impacted. 

The hackers have previously threatened to leak the data, starting with 1,000 famous Australians, unless Medibank pays a ransom. 

Medibank on Wednesday also confirmed it was not insured against cyber attacks, estimating the hack could cost the company as much as Au$35 million (US$22 million). 

The Medibank hack followed an attack on telecom company Optus last month that exposed the personal information of some nine million Australians -- almost a third of the population. 

The Optus attack was one of the largest data breaches in Australian history. 

'Inadequate'

Australia's Attorney-General Mark Dreyfus has previously accused companies of stockpiling sensitive customer data they did not need. 

Firms currently face paltry fines -- Au$2.2 million -- for failing to protect customer data. 

Dreyfus last week said these fines would be ratcheted up to Au$50 million. 

"Unfortunately, significant privacy breaches in recent weeks have shown existing safeguards are inadequate," he said. 

"It's not enough for a penalty for a major data breach to be seen as the cost of doing business." 

Home Affairs Minister Clare O'Neil on Tuesday said the fallout from the Medibank hack was "potentially irreparable". 

"One of the reasons why the government is so worried about this is because of the nature of the data," she told Australia's parliament. 

"When it comes to the personal health information of Australians, the damage here is potentially irreparable." 

O'Neil has previously described hacking as a "dog act" -- an Australian phrase reserved for something especially shameful or despicable.

Purdue Pharma pleads guilty to criminal charges over opioid sales

US drugmaker Purdue Pharma pleaded guilty to three criminal charges over its intense drive to push sales of the prescription opioid OxyContin, which stoked a nationwide addiction crisis, the Justice Department announced Wednesday. 

Purdue also agreed to $8.3 billion in fines, damages and forfeitures to settle the criminal case against it, the department said. 

In a separate agreement, the billionaire Sackler family, which built Purdue to a pharmaceutical giant on the back of lucrative sales of OxyContin, agreed to pay $225 million to resolve civil liability charges filed by the Justice Department. 

"Purdue, through greed and violation of the law, prioritized money over the health and well-being of patients," said FBI assistant director Steven D'Antuono. 

Purdue, which filed for bankruptcy protection last year, pleaded guilty to one count of fraud and two counts of violating kickback laws over its marketing and sales of OxyContin and two other hydrocodone-based treatments, which involved encouraging distributors and doctors to aggressively push the highly addictive drugs to consumers. 

Even after paying $600 million for falsely marketing the painkiller as "less addictive," the Justice Department said, Purdue ratched up its sales drive and developed new addictive applications which it marketed through a network of 100,000 prescribing doctors and nurse practitioners. 

Among them were thousands of hyper-prescribers that Purdue "knew or should have known were prescribing opioids for uses many of which were not for a medically accepted indication, were unsafe, ineffective, and medically unnecessary," or which were resold on the black market, the charges said. 

To encourage them Purdue had a program dubbed "Evolve to Excellence" which offered financial and other incentives, particularly offering doctors lucrative speaking gigs, which amounted to kickbacks for pumping out more prescriptions of the company's drugs. 

Its activities, combined with those of other prescription opioid producers and distributors, fed an epidemic of addiction. Millions of Americans became dependent on the painkillers while the drugmakers reaped billions of dollars in profits.

According to the Centers for Disease Control and Prevention, more than 500,000 Americans have died of opioid overdoses -- both prescription and non-prescription -- since 1999. 

In a statement, Steven Miller, Purdue's chairman since 2018, said the company "deeply regrets and accepts responsibility for the misconduct detailed by the Department of Justice." 

"Purdue today is a very different company. We have made significant changes to our leadership, operations, governance, and oversight," he added. 

Purdue also faces billions of dollars in claims from state and local authorities around the country, and in September 2019 filed for bankruptcy to fend off more legal claims against it. 

Because of the bankruptcy and competing claims from litigants and creditors, the Justice Department admitted it might not see all of the $8.3 billion the company agreed to pay on Wednesday. 

But the agreement mandated that the company be dissolved and its assets be placed in a new "public benefit company." 

"The PBC would be charged with providing its medicines in a manner as safe as possible, without diversions, while providing millions of doses of medicines to treat opioids addiction and reverse overdoses and otherwise taking into account long-term public health interests," said Deputy Attorney General Jeffrey Rosen. 

The Sacklers, he added, would have no role in that company. He added that the civil fine against the family did not preclude future criminal charges against them, amid public pressure to wrest back the profits they earned on the addiction epidemic. 

In a statement, New York state Attorney General Letitia James said her office will continue to pursue the family. 

"Today's deal doesn't account for the hundreds of thousands of deaths or millions of addictions caused by Purdue Pharma and the Sackler family," James said in a statement. 

"While no amount of money can ever compensate the pain that so many now know, we will continue to litigate our case through the courts to secure every cent we can to limit future opioid addictions," she said.

New York (AFP) - The founder of Insys Therapeutics on Thursday became the first head of a major US pharmaceutical to be convicted of bribing doctors to prescribe addictive painkillers blamed for fueling an opioid crisis that has claimed tens of thousands of lives.

John Kapoor, 76, was found guilty of criminal conspiracy, along with four other former executives of the Arizona-based firm.

The former billionaire and his co-defendants, including regional sales director Sunrise Lee, a former stripper, face up to 20 years in prison, and will be sentenced at a later date.

Two other executives pleaded guilty and testified at the trial in Boston which lasted a little over two months.

"Today's convictions mark the first successful prosecution of top pharmaceutical executives for crimes related to the illicit marketing and prescribing of opioids," federal prosecutor Andrew E. Lelling said in a statement.

"Just as we would street-level drug dealers, we will hold pharmaceutical executives responsible for fueling the opioid epidemic by recklessly and illegally distributing these drugs, especially while conspiring to commit racketeering along the way," he said.

In 2017, President Donald Trump declared the opioid crisis a national public health emergency.

Almost 400,000 people have died from overdoses involving prescription or illicit opioids over the past two decades, according to the Centers for Disease Control and Prevention. Nearly 48,000 people died in 2017 alone from opiate overdose.

"This is a landmark prosecution that vindicated the public's interest in staunching the flow of opioids into our homes and streets," Lelling said.

To increase sales of their fentanyl spray Subsys, a painkiller 50 to 100 times stronger than morphine, Insys executives set up a system of large-scale bribes.

Between 2012 and 2015, they paid health professionals to prescribe large quantities of the highly addictive drug, which was approved to alleviate severe pain in terminal cancer patients.

Doctors were encouraged to recommend the spray to patients who did not need it and also in excessive doses.

Officially, the bribes were paid as fees to doctors speaking at seminars for health professionals to praise the benefits of the drug.

The company's aggressive marketing tactics reportedly also included sales representatives making a rap video to promote the drug.

In some years, Insys paid more than $10 million in bribes in this way. The heads of the firm also set up a scheme to mislead health insurance companies to reimburse patients for the costs of the drug.

According to Insys' annual report, Subsys sales reached $329.5 million in 2015.

The group went public in 2013. Kapoor resigned from the board in October 2017, a few days after his indictment.

A group made up of more than 500 cities, counties and Native American tribes across the United States has filed a massive lawsuit accusing members of the Sacklerfamily, who own the maker of the opioid painkiller OxyContin, of helping to create “the worst drug crisis in American history”.

The lawsuit represents communities in 26 states and eight tribes and accuses Sackler family members of knowingly breaking laws in order to enrich themselves to the tune of billions of dollars, while hundreds of thousands of Americans died.

“Eight people in a single family made the choices that caused much of the opioid epidemic,” the lawsuit, filed earlier this week in federal court in the southern district of New York, states.

The same eight members of the family had recently been added to a small number of lawsuits that are underway against a string of opioid-makers, including the Connecticut-based pharmaceutical company the Sacklers wholly own, Purdue Pharma, but they have not been sued as individuals on anything like this scale before.

“This nation is facing an unprecedented opioid addiction epidemic that was initiated and perpetuated by the Sackler defendants for their own financial gain, to the detriment of each of the plaintiffs and their residents. The ‘Sackler defendants’ include Richard Sackler, Beverly Sackler, David Sackler, Ilene Sackler Lefcourt, Jonathan Sackler, Kathe Sackler, Mortimer DA Sackler, and Theresa Sackler,” this week’s lawsuit states.

The eight are the most high-profile members of a family which has long been known for prolific philanthropy to famous arts and education institutions, including the Metropolitan and Guggenheim museums in New York, which have faced fierce recent protests against the taking of Sackler money. Other institutions include Columbia, Yale, MIT, Tufts and other US universities, and, in the UK, the Victoria & Albert Museum, the Serpentine Gallery, Glasgow University and other recipients.

Earlier this week Britain’s National Portrait Gallery decided not to take up the offer of a £1m Sackler family grant and, in the US, Columbia University and the University of Washington, which have both received Sackler donations in the past, have announced they are not now accepting gifts from the family.

Court documents accuse the eight family members of purposely playing down the dangers of the prescription painkiller OxyContin, which is more potent than heroin or morphine. They are accused of deceiving doctors and patients and directing sales and marketing techniques that drove huge over-prescribing and ever stronger doses for many patients who should never have been prescribed the pills in the first place.

“The defendants’ actions caused and continue to cause the public health epidemic…caused deaths, serious injuries, and a severe disruption to public peace, order and safety, it is ongoing and it is producing permanent and long-lasting damage,” the court documents allege.

Many of the allegations have already been made public in a lawsuit naming the same eight family members in Massachusetts, and are contained in court documents in the multi-district litigation taking place in a federal court in Cleveland, Ohio, which has been brought against Purdue and other companies, though no members of the Sackler family individually, by more than 1,200 cities and counties.

The family and Purdue deny wrongdoing.

“This complaint is part of a continuing effort by contingency-fee counsel to single out Purdue, blame it for the entire opioid crisis in the United States, and try the case in the court of public opinion rather than the justice system,’’ Robert Josephson, a Purdue spokesman, said in an emailed statement to the Bloomberg news agency.

“These baseless allegations place blame where it does not belong for a complex public health crisis, and we deny them,’’ the Mortimer and Raymond Sackler families said in a statement. They also noted OxyContin sales “represented a tiny portion of the opioid market”.

The lawsuit filed in New York on 18 March is extraordinary because it focuses almost entirely on the individual Sacklers.

Richard and Jonathan Sackler are sons of the late Raymond Sackler, one of the founding brothers of Purdue. Beverly is Raymond’s widow and David his grandson.

Ilene, Kathe and Mortimer David Alfons are children of the late Mortimer Sackler, another of the founding brothers of Purdue, and Theresa is his widow.

The only other defendants named in the lawsuit are the family trust connected to Raymond Sackler’s branch of the family and Rhodes Pharmaceuticals, a company owned by the Sacklers that produces generic opioid painkillers.

Other cases focus mostly on Purdue and other well known pharmaceutical giants involved in opioid production, such as Johnson & Johnson and Allergan.

The lawsuit in the southern district of New York has been brought by city and county authorities across America, including, for example, 42 counties and cities in Alabama, 31 counties in California, 21 cities and counties in Florida, 28 counties in Illinois, 51 cities and counties in Kentucky, more than 100 towns and cities in Massachusetts and dozens of cities and counties in other states including Wisconsin, Virginia, Utah, Tennessee, Missouri, New Hampshire, New Mexico, Indiana and Michigan.

Among the eight Native American tribes suing the Sacklers are parts of the Cherokee, the Chippewa and the Sioux, the Oneida Nation and the Blackfeet.

Drug overdoses now kill more than 72,000 people in the US a year, according to government figures from the Centers for Disease Control and Prevention, and 49,000 of those are caused by opioids.

Purdue’s business has attracted a wave of lawsuits alleging deception about the safety of OxyContin, which the company had admitted misbranding in a 2007 criminal case.

Purdue has not ruled out filing for bankruptcy, which would cause a hiatus in the civil cases brought against it, but also indicates it could be short of the kind of funds that would be needed for a massive settlement or a fine at trial in the cases against it, to compensate communities for the cost of the crisis.

But a victory in the latest lawsuit against the Sacklers would give the plaintiffs access to the Sacklers’ personal fortune.

Leeuwarden prison experiments with family space for fathers

A prison in Leeuwarden in the province of Friesland is experimenting with a special wing for fathers aimed at bringing down repeat offending, the Volkskrant reported over the weekend. 

The wing, which is expected to open officially next year, consists of a family room where fathers and children can play or do homework together unsupervised by close circuit cameras but with staff present. They will also have the possibility to use Skype to talk to their children at home.

‘If a father is concerning himself with the future of his child he is also working on his own future,’ director of the prison Anna Nijstad told the paper. ‘Fathers stay in contact with their family. That increases the chances of a successful reintegration after the sentence has been served.’ 

Some 900 convicted criminals are sent to the Leeuwarden prison a year, of which 400 are men with families. Some 20 fathers are participating in the project, which is based on a similar project at a Welsh prison. Parc Prison has had a special wing for delinquent fathers for years which has resulted in fewer of them re-offending, the paper writes. 

Participants will only be eligible for the privilege after a strict screening and will be under the supervision of the probation services and social organisations. 

Strengthening the bond between children and their delinquent fathers is a potentially great way of limiting reoffending, according to Leeuwarden mayor Ferd Crone. 

‘Perhaps the most important reason not to get reoffend is that men don’t want to disappoint their children and partners again,’ he told the paper.

Madrid (AFP) - A Spanish-led European police investigation has broken up an organised crime group that allegedly sold horsemeat across Europe that was "not suitable" for human consumption, officials said Sunday.

Police in Spain arrested 65 people suspected of crimes including animal abuse, document forgery, public health violations, money laundering and being part of a criminal organisation, Europe's policing agency Europol said in a statement.

The suspected leader of the group, a Dutch national, was arrested in Belgium, it added.

Spain's Guardia Civil police force began their investigation in 2016 after detecting "unusual behaviour" in horsemeat markets.

"They detected a scam whereby horses in bad shape, too old or simply labelled as 'not suitable for consumption' were being slaughtered in two different slaughterhouses," Europol said.

The horses came from Portugal and northern Spain and their meat was processed at an unspecified location from where it was sent to Belgium, one of the biggest horsemeat exporters in the European Union.

The group is suspected of having modified the horse's microchips and documentation to pass off the meat as edible.

The meat was sold across Europe and may have earned the group over 20 million euros ($23 million) per year, Spanish police said in a separate statement.

The Guardia Civil worked in cooperation with police in Belgium, Britain, France, Italy, Portugal, Romania, Switzerland and the Netherlands, the statement added.

Spanish police seized five luxury cars as part of the investigation and blocked several bank accounts.

The investigation stems from a British horsemeat scandal in 2013 when frozen burgers supplied to several supermarkets were found to contain horse DNA.

Uruguay to sign up smokers to buy state marijuana

Montevideo (AFP) - Uruguay will this month start signing up smokers to buy marijuana from pharmacies in the world's first scheme for state-production and sale of the drug, an official source said Wednesday.

The leftist government has begun harvesting its own marijuana and aims to start selling it in mid-August, the source told AFP.

The marijuana leaves have been grown under heavy security at privately operated, state-supervised farms.

"It is being harvested and dried," said the source, who asked not to be named.

The government will buy the drug from the producers and sell it on to the pharmacies. But the amount released for sale will depend on how many users register.

The government aims to start registering users by the end of this month, the source said.

Under a law passed in 2013, Uruguay already allows users to grow marijuana if they register as members of state-regulated clubs.

The state will now expand that initiative to regulate the sale of the drug in pharmacies.

The law allows for users to buy up to 40 grams (1.4 ounces) a month. Authorized buyers will be identified by their fingerprints.

The scheme is being overseen by the state Cannabis Regulation and Control Institute.

Officials have not ruled out extending sales to establishments other than pharmacies.

The initiative was launched by former president Jose Mujica as a way to undermine drug-trafficking gangs.

A poll at the time indicated that nearly two thirds of Uruguayans were opposed to the law.

A global police operation has seized a record amount of illicit food and drink, including monkey meat, painted olives and sugar with fertilizer. Fake food and drink is a multi-billion euro criminal industry.

Law enforcement from 57 countries seized 10,000 metric tons of food and 1 million liters of drink in a crackdown on criminal networks that pose a threat to public health, Interpol said on Wednesday.

"Fake and dangerous food and drink threaten the health and safety of people around the world, who are often unsuspectingly buying these potentially dangerous goods," said Michael Ellis, head of Interpol's Trafficking in Illicit Goods unit.

Dubbed Operation Opson V, the joint Interpol-Europol operation conducted between November 2015 and February 2016 targeted criminal networks concerned only about "making a profit, no matter what the cost to the public," Ellis said.

Officers seized nine tons of sugar contaminated with fertilizer in Sudan, 85 tons of olives painted with copper sulphate in Italy and 70 kilograms of chicken guts preserved in the prohibited additive formalin.

Customs officers at Belgium's Zaventum airport found several kilograms of monkey meat, while in France officers seized 11 kilograms of locusts and 20 kilograms of caterpillars.

In Thailand, police seized 30 tons of illegal beef and buffalo meat unfit for human consumption and in Bolivia the operation found thousands of cans of sardines with fake labels of a famous Peruvian brand.

The operation also yielded dangerous fake alcohol across the globe.

Five prisons to close as falling crime rate leaves cells empty

More prisons will close in the next few years as the government looks to cut the cost of hundreds of empty cells, justice minister Ard van der Steur has told parliament. 

The Telegraaf says it has obtained internal documents revealing that the government plans to shut five prisons, with the loss of 1,900 jobs. A further 700 staff will be given ‘mobile’ positions, though the exact meaning of this is unclear. 

The downward trend in crime, which has fallen by an average of 0.9% in recent years, is expected to mean 3,000 prison cells and 300 youth detention places will be surplus to requirements in five years’ time. 

Van der Steur also said that judges were imposing shorter sentences, meaning criminals were spending less time on average in jail. More serious crimes are also becoming less common, he added. 

After finalising plans to close 19 prisons last year, the justice ministry said there were no plans for further cuts, but Van der Steur said the empty cells were costing the state too much. 

Socialist Party MP Nine Kooiman said it was a ‘scandal’ that the government was breaking its earlier promise. ‘If this cabinet was really working to catch crooks, we wouldn’t have this problem of empty cells,’ she said.

The Dutch government has reclaimed part of the cost by importing prisoners from countries with a surplus. Last September the first of 240 Norwegian convicts were transferred to Veenhuizen jail, in Drenthe, under a deal between the two governments for an initial period of three years.

“… "Wow, Kryon, how long is that going to take?"

The Humans in the room control that and those listening later and reading. When you leave this room, what are you going to do? Go home, report this, rub your hands together, and wait for it to happen? It won't. For the Humans in the room and the old souls hearing and reading have got work to do, and I've told you this before. You've got work to do.

There's an alliance that you're going to have to create with one another and with another group - the young people of Earth. The youth of this earth are changing the way things work. Can you see it? You're not supposed to sit around and watch them either, because they need you, old soul.

It's time for you to align with the indigos and the concepts of the youth of the planet. Do not think for a moment that their age shows their wisdom. These two attributes are not commensurate with one another; they're not linear. These young people may be older souls than you are! Don't think that because they've got technology that you don't understand that you can't be one with them. Their technology is social networking, the very thing we are talking about, where everyone can talk to everyone. The new consciousness on the planet starts in two areas - the children and the old souls.

Conclusion

This is the message of the day. The recalibration of awareness is going to change systems, education, government and finance. Those who don't choose to be spiritual at all will still move with a new awareness, for they will be aware of something that they are not aware of now - a softer way of living.

We close with a trite statement that we've given before, but that many have stated in jest: "If women ran the world, they would never send their sons to be killed on a battlefield."

Many laugh. How trite, how simple minded. Indeed, there have been women leaders who have put wars together; they had to. They sent their sons, so that's not really a correct statement. However, it's more right than you may think, dear ones.

So now I will make the statement I have made over and over in these recalibrated channellings: "When recalibrated Humans run the world, there will come a day when they will never send their sons into the battlefield." You see, awareness will change all of that. They will eventually see the wisdom of unification, new ways to settle issues, and the intuitive attribute of putting things together instead of tearing them apart.

There will be a time when government armies will not need to be large, and weapons will not be as powerful. Slowly, government won't need them. Slowly, slower than you want, these things will happen as the old soul carries his light and looks at the masters of the planet and emulates them.

You've all heard it: There will come a time when the masters will come back to Earth, and there are many who are waiting for this. However, it has already happened! They couldn't come back until the alignment was right and now it is right. This is what you are feeling in 2012 and beyond. It's starting to happen, and they're back. But they're not back as corporeal Human Beings. They're back as the energy of recalibrating of the awareness of God.

I wouldn't say these things unless they were true. Watch for these things, dear ones. Remember where you heard them first and when some of them start to occur in your news. And when you see the earth working in this fashion, dear one, maybe you'll realize that what I have given today is real.

Be circumspect. There is no perfect timing. Humans will create all this at their own pace. Do not be in fear of the things that might follow, for I say it yet again that the old energy will show itself soon in survival mode and it won't be pretty.

In this beginning of new energy, stand tall and turn on your light. Darkness will shirk before you. That is the truth of the day.
